Terms of service
These are the terms for using Aivo, written to be read. They form an agreement between Aivo ("Aivo," "we") and the business that uses the service ("you"). By activating an Aivo agent, you agree to them. If you do not agree, do not use the service.
What Aivo does
Aivo provides inbound AI phone coverage only. It answers the calls your team misses, gathers what the caller needs, and delivers a callback to your team by text and email. On each call it identifies itself as an AI assistant and gives a transcription disclosure. It does not make outbound sales calls. It does not book appointments unless a real calendar integration confirms the booking. It does not handle payments, medical, legal, financial, emergency, or identity matters on calls, and calls that need any of those are transferred to a person by fixed rules.
What Aivo says on your behalf
Aivo speaks only the facts you have approved for the agent to state. It never invents a price, availability, appointment, discount, warranty, or policy. Anything outside your approved facts is answered with "the owner will confirm."
Your responsibilities
- Accuracy of your facts. You are responsible for the accuracy of the facts you approve for the agent to state, since Aivo speaks only what you approve.
- Consent. You are responsible for obtaining any consent required to text or email the people whose contact details Aivo collects for you.
- Lawful use. You are responsible for using the service lawfully. You are the controller of your callers' data, and Aivo processes it on your behalf.
Acceptable use
Do not use Aivo for emergency dispatch or life-safety purposes, for medical, legal, or financial advice, to collect payment-card numbers or identity documents, to harass or deceive callers, or for any unlawful purpose. Do not misrepresent the agent as a human. Aivo is a coverage and message-taking tool, not a substitute for professional advice or emergency services.
Service activation
An agent only goes live after the agreed setup and line tests pass. Nothing answers a real call until then.
Fees and billing
The service is a monthly subscription of $249 per month per location, billed in advance through Stripe, including 500 answered minutes a month; additional minutes are billed at 35 cents each on the next invoice. There is no long-term commitment: cancel any time from Setup and coverage continues to the end of the paid period. Message and data rates may apply to SMS.
Availability
We work to keep Aivo running, but we do not guarantee that the service will be available without interruption or error. Telephony, email, and the underlying providers can fail or be delayed for reasons outside our control, and there is no absolute uptime guarantee.
Disclaimer of warranties
The service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will capture every call or lead, or that it will produce any particular business result.
Limitation of liability
To the fullest extent permitted by law, Aivo will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, revenue, or business, arising from your use of the service. Our total liability for any claim relating to the service is limited to the fees you paid for it. Aivo is a coverage tool; it is not a guarantee of any business outcome.
Changes to the service and these terms
We may change or discontinue features of the service, and we may update these terms. When we update them, we will change the date at the top of this page. Continuing to use the service after a change means you accept the updated terms.
Termination
You may stop using Aivo at any time. We may suspend or end the service if these terms are broken or if we can no longer provide it. On termination, your data is handled under the retention and deletion windows described in the privacy page.
Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules.
